L’oro e la coscienza. La fiducia testamentaria nell’età dei codici

The legal systems of ancient, medieval and early modern ages have conferred validity to the confidential testament (fideicommissum fiduciarium or testamentum confidentiale) and provided the last secret wills with protection. Such tradition still persisted in the 19th century, despite of the new rules that the civil codes introduced to protect the certainty of testamentary dispositions. After an overview of the fiduciary wills in Roman law and during the age of the ius commune, this essay highlights the trends of both jurisprudence and doctrine in relation to the new regulations: the Code Napoléon, the Italian Civil Codes of the Restoration and the Italian Civil Code of 1865.

Gli ordinamenti giuridici delle età antica, medievale e moderna hanno riconosciuto la validità del testamento fiduciario e fornito tutela alle ultime volontà segrete. Questa tradizione di favore persiste anche durante la prima età contemporanea, a dispetto del nuovo regime introdotto dai codici civili a presidio della certezza delle disposizioni di ultima volontà. Dopo una panoramica rivisitazione della disciplina del testamento fiduciario nell’ordinamento giuridico romano e nell’età dello ius commune, il presente saggio mette in luce le tendenze della giurisprudenza e della dottrina di fronte al Code Napoléon, ai codici civili italiani dell’età della Restaurazione e al codice civile italiano del 1865
