The essay is aimed to disclose the genealogy of the contract law theories in the USA legal tradition. The privileged point of view used to filter authors and thoughts is represented by Grant Gilmore’s works. The originality of the intellectual investigation lies in the fact that the analysis of substantial legal issues is closely linked to the study (qualification and interpretation) of the specific style adopted by different scholar to form and express their ideas. On this ground, the common way of understanding the concepts of ‘mentality’ and ‘legal tradition’ within the field of comparative law are integrally re-substantiated.
