The essay critically investigates the genealogies of the encounter between Law and the Humanities. After having unfolded the different attitudes and points of view that now compose the canon of the interdisciplinary project, the Author intends to disclaim the reversive subversion hidden under the contemporaneous cultural turn so to propose an original reassessment of the bridge launched from Law to other fields of knowledge and research. In particular, the claims brought by a new consciousness on the ontological ambiguity of Law, apt to put the Law itself in a permanent threshold with respect to other humanist domains, are collected under the innovative label “Nomos and Representation”. Within this framework, the intermingling relationship between Law and Non-Law becomes constitutive of three dimensionalities, that are aesthetic ontology, spatiality and textuality.
Il saggio analizza in modo critico le ragioni genealogiche che hanno giustificato l’intersezione tra Diritto e Scienze Umane, ponendo sotto interrogazione la costruzione stessa del progetto interdisciplinare. Attraverso una rigorosa decostruzione delle prospettive che ne hanno codificato il canone, l’Autrice svela la latente sovversione regressiva mascherata come traguardo della modernità per tornare alle origini delle connessioni tra diritto e altri ambiti del sapere. La proposta di una nuova epistemologia critica si articola attorno al concetto di "Nomos e Rappresentazione", un’inedita chiave di lettura che esplora la permeabilità tra Diritto e Non-Diritto. Questa soglia permanente viene analizzata attraverso tre direttrici principali: la dimensione ontologico-estetica; la dimensione spaziale; la prospettiva intertestuale.
