The study aims at providing legal solutions to various issues regarding unaccompanied foreign minors, recently tackled by the Italian legislator, especially considering the results of the case law and the obligations resulting from the ratification of relevant international treaties. The essay mainly deals with the Italian law 47/2017, an innovative normative intervention that could be a model for other European legislations. The analysis focuses on the protection of fundamental rights of these minors, with particular regard to their right to a correct identification. Through a child protection approach, the Author examines the major issues that affect the vulnerability of these persons, in the perspective of recognition of their right to identity and to a nationality.
