The essay highlights the connections between the evolution/implementation of the It.Republican Constitution in terms of fundamental economic choices and some dominant strands of the economic doctrine of the Twentieth Century. What emerges from the research is a dialogue that often appears merely formal, in the sense that the dominant economic doctrines have often been reduced to "labels" (e.g. Keynesian or anti-Keynesian Constitutions) and as such have been used or contested in public law analysis. This happened with regard to the dominance of the assumptions of economic development accepted by Keynes (fundamental in the entire narrative of post-war reconstruction and the system of State shareholdings as well as in the analysis of the limits and inefficiencies of the State-entrepreneur) as well as for the narration of the neoliberal doctrines that have influenced the choices of States at a global level since the eighties and nineties of the last Century. After the introduction into the Constitution of the notion of "tutela della concorrenza" as a task reserved exclusively to the state law (2001) and of the parameters for enforcing the rule of “balanced budget” (2012), the need to fruitfully dialogue with economic theories it also becomes crucial for constitutional jurisprudence. Even on these fronts there was often uncertain and inconsistent interpretative passages: in fact, quite a few interpretative difficulties emerged in rendering the possible readings of those economic notions in legal terms.

Il saggio ricerca ed evidenzia le connessioni tra l’evoluzione/attuazione della Costituzione repubblicana sul versante delle scelte economiche fondamentali e alcuni filoni dominanti della dottrina economica del Novecento. Dalla ricerca emerge un dialogo che sovente appare meramente formale, nel senso che le dottrine economiche dominanti sono state spesso ridotte a “etichette” (ad es. costituzioni keynesiane o anti-keynesiane) e come tali sono state utilizzate ovvero contestate nell’analisi giuspubblicistica. Ciò è accaduto per quanto attiene alla dominanza dei presupposti dello sviluppo economico accolti da Keynes (fondamentale in tutta la narrazione della ricostruzione post bellica e del sistema delle partecipazioni statali nonché nell’analisi dei limiti e delle inefficienze dello stato-imprenditore) come anche per la narrazione delle dottrine neoliberali che condizionano le scelte degli Stati a livello globale fin dagli anni ottanta e novanta del secolo scorso. Dopo l’introduzione nella Costituzione della nozione “tutela della concorrenza” come compito riservato in via esclusiva al legislatore statale (2001) e dei parametri per far valere l’equilibrio/pareggio di bilancio (2012) la necessità di dialogare fruttuosamente con le teorie economiche diventa cruciale anche per la giurisprudenza costituzionale. Anche su questi versanti non sono mancati passaggi incerti e poco coerenti: sono infatti emerse non poche difficoltà interpretative nel rendere in termini giuridici le possibili letture di quelle grandezze economiche.
