L’influenza delle indagini sul dibattimento

The contribution analyzes the oscillation of relationships and osmotic reactions between investigations and proceedings, which represent the litmus test to verify, after more than thirty years from the entry into force of the current code of procedure, the current physiognomy of the process penalty, allowing - at the same time - to take stock of the estate of the principles and objectives pursued by the first code of the republican age.

Il contributo analizza l'oscillazione delle relazioni e reazioni osmotiche tra indagini e dibattimento, che rappresentano la cartina di tornasole per verificare, ad oltre trent’anni dall’entrata in vigore del vigente codice di rito, l’attuale fisionomia del processo penale, consentendo – nel contempo – di operare un bilancio sulla tenuta dei principi e degli obiettivi perseguiti dal primo codice dell’età repubblicana.
