The article deals with the role of legal comparison in the study of legal prohibitions on the abuse of economic dependence that are found in Italy and so many other national jurisdictions, that have followed the German example over the year. The article addresses the following issues: how to traslate such generic legal standards into workable rules, the relationship to the antitrust prohibition on anticompetitive agreements and the abuse of a dominant position, functions and limits of public enforcement.
Il saggio tratta del ruolo della comparazione della giuridica nello studio dell’abuso di dipendenza economica, e cerca di evidenziare le indicazioni di massima che se ne possono utilmente trarre, in ordine in ai principali problemi che occupano gli interpreti e i legislatori, in Italia e negli altri Paesi che hanno recepito il divieto di a.d.e.: concretizzazione del divieto, rapporti con i divieti antitrust di intese e di abuso di posizione dominante, funzione e limiti del public enforcement.
