Le indagini tecniche

In the criminal trial, science and technology have increasingly entered and have become ordinary working tools through technical-scientific investigations. The opportunities for knowledge that derive from such investigation activities and then scientific evidence must, however, be treated with the prism of the indispensable protection of the fundamental rights of the individual, as well as in the awareness of the possible errors that may be hidden in them. The paper analyses the problems, also in light of the main jurisprudential orientations.

Nel percorso di ricostruzione dei fatti di reato, scienza e tecnologia hanno sempre più frequente ingresso e sono divenuti ordinari strumenti di lavoro tramite le indagini tecnico scientifiche. Le opportunità conoscitive che derivano da tali attività di indagine e poi di prova scientifica vanno, però, trattate con il prisma della irrinunciabile tutela dei diritti fondamentali dell’individuo, oltre che nella consapevolezza dei possibili errori che in esse si possono annidare. Lo scritto ne analizza le problematicità, alla luce anche dei principali orientamenti giurisprudenziali.
