The essay analyzes the notion of family relationship and legal status of the born. In recent years there have been significant changes. The perspective has been reversed, in accordance with what for centuries has been the foundation of family relation-ships. The contemporary state tends to protect increasingly subjective legal situations as such, regardless of belonging to a given group.

Il saggio analizza la nozione di rapporto familiare e di stato giuridico del nato. In questi ultimi anni vi sono stati significativi cambiamenti. La prospettiva si è rovesciata rispet-to a quella che per secoli ha costituito il fondamento dei rapporti familiari. Lo Stato contemporaneo tende a tutelare in misura crescente le situazioni giuridiche soggettive in quanto tali, prescindendo dall’appartenenza ad un dato gruppo.
