The paper reviews the financial governance of the Italian public health system in 2010. We examine the recent decree on implementation of fiscal federalism and the innovations suggested by the central Government in order to provide a better distribution of health care resources among Regions. Despite the wide general discussion, there is no indication on how to improve resources allocation; no update has been introduced on the capitation weighting systems; the procedure to define national resources in order to ensure essential levels of care is unclear. The decree is therefore an example of that excess production of legislation ever seen in the current Italian reality, creating uncertainty, conflict and encumbrances.
