The paper analyses the means aimed at promoting, protecting and ensuring the full and equal enjoyment of all human rights and fundamental freedoms for all persons with disabilities and to promote the respect for their dignity. The «amministrazione di sostegno» avoids a disproportionate or undue burden and ensures to persons with long-term physical, mental, intellectual or sensory impairments the exercise of rights and freedoms on an equal basis of other people. Persons with disabilities are «subjects» with rights, who are entitled to claim them rights and take decisions for their lives based on their free and informed consent. The «amministrazione di sostegno» enables the adoption of the living will, which is not provided for in the Italian law, and of the protective Trust, a form of settlement in which the assets are held to pay an income to the beneficiary.
