Analizzando il percorso argomentativo dei giudici costituzionali nella sentenza n. 309 / 2003, il contributo ricostruisce le linee essenziali di una questione che riguarda un difficile bilanciamento tra interessi confliggenti, entrambi meritevoli di tutela. Da un lato, si pone l'interesse dello Stato alla garanzia dell'ordine pubblico e della pubblica sicurezza (alla luce del quale va considerata la presenza nell'ordinamento dell'istituto delle misure di prevenzione); dall'altro, occorre riconoscere l'interesse della persona, sottoposta alla misura di prevenzione, al rispetto del disposto costituzionale che ne tutela la libertà religiosa e dunque anche il diritto di esercitare il culto in forma associata. In the case n. 309/2003, the Italian Constitutional Court found the prohibition to the applicant, subject to preventive measures, of attending services in a place of worship, justified by the “compelling” interest of the State to preserve public order. Following the lines of argument explained by the Court, the article focuses on the main issues emerging from the complex question of balancing conflicting fundamental rights. On one hand, the State has to comply with its duties of granting public order and security (since this is the reason that justifies the adoption of preventive measures against individuals who have not actually committed crimes). On the other hand, stands the constitutional protection of religious freedom, that involves the right to worship in community with others.

Abstract
