The paper is focused on the last case-law of Court of Justice concerning the freedom of movement of the citizens of Third Countries who are family members of EU citizens. That case-law is analised from the point of view of the interpretative arguments put in place of the Court. Such arguments are the same also in the case where the conclusions are different, as it may be observed in the judgements Ruiz Zambrano and MacCharty.
