The scope of this research is to offer solutions on an international level to the complex problems arising in Italy both from the violation of the existing Italian law and the diversity of the judicial rulings made in each concrete case. The current law prohibiting surrogacy, indeed, generates interpretative uncertainties and the principle of favour minoris risks being compromised every time an Italian couple returns to Italy with a child born abroad from a surrogate mother.
