The essay provides a frame of the direct establishment of parentage (which nowadays is not based only on the biological data) and of the differences between the concepts of «filiazione-titolo» and «filiazione-rapporto», through the analysis of the Italian constitutional case-law, with particular reference to the recent judgement (no. 272/2017) on the interest of the child to his/her status towards the intentional parent within surrogacy. The work will be carried out in the perspective of the protection of identity rights and affectivity, which gave rise to the last interventions of the legislator and of the aforesaid case-law in the field of parentage.
