The paper discusses Mommsen’s thesis according to which the condemnation to hard labour in imperial weaving factories (appeared in the fourth century A.D.) is a form of damnatio in opus publicum. Analysing the sources, mainly Patristic writings, the hypothetical conclusion is that, despite similarities, the punishment shies away from Mommsen’s framework because of the consequences on the legal position of the condemned: women and men – the sources only mention honestiores, mostly Christians at the time of the Great Persecution or those involved in political events – forcibly assigned in imperial weaving establishments and bound to the condicio of workers employed in a public service.
Il saggio discute l’ipotesi di Mommsen per la quale la condanna al lavoro forzato nelle manifatture tessili imperiali, apparsa nel IV sec. d.C., è una forma di damnatio in opus publicum. La conclusione ipotetica raggiunta attraverso l’esame delle fonti, per lo più scritti patristici, è che nonostante le analogie, la pena sfugge tale inquadramento per le conseguenze sulla posizione giuridica dei condannati: donne e uomini – le fonti parlano solo di honestiores, per lo più cristiani al tempo della grande persecuzione o coinvolti in vicende politiche – forzosamente inquadrati nelle tessiture imperiali e vincolati alla condicio di lavoratori impiegati in un pubblico servizio.
