In the context of the Covid-19 crisis, several EU Member States have introduced controls at the internal borders within the Schengen area, invoking the clauses of the Schengen Borders Code on the temporary reintroduction of such controls to respond to serious threats to public policy or internal security; moreover, coordinated decisions to close the EU external border have been enacted. Such measures have given rise to unprecedented challenges for the integrity of Schengen regime, stemming from the risk of disintegration that might ensue from a practice of fragmented and discriminatory removal of controls and restrictive measures, even more than from their re-introduction. This article reviews and assesses the role of the European Commission in promoting a coordinated approach to the introduction, and especially to the lifting, of controls and containment measures inside the EU and outwards, establishing the phases, criteria and limits of such a process in order to preserve the Schengen system.
Per contenere la diffusione del contagio nel contesto dell’emergenza sanitaria da Covid-19, alcuni Stati membri dell’UE, oltre a disporre restrizioni ai viaggi, hanno ripristinato i controlli alle frontiere interne, invocando le clausole del “codice frontiere Schengen” che ne autorizzano la reintroduzione temporanea in caso di minacce all’ordine pubblico e alla sicurezza interna, sollevando la questione se tali possano qualificarsi gravi minacce alla salute pubblica. Inoltre, a livello dell’Unione è stata decisa la chiusura coordinata delle frontiere esterne. Tali misure hanno generato sfide inedite per la tenuta dello spazio Schengen, legate, più ancora che all’introduzione delle misure restrittive e di controllo, al rischio di sgretolamento derivante dalla loro revoca frammentata, parziale e “in ordine sparso”. L’articolo ricostruisce e valuta il ruolo della Commissione europea nel promuovere, a salvaguardia del regime Schengen, un approccio coordinato all’introduzione e soprattutto alla revoca di controlli e restrizioni alle frontiere interne ed esterne, processo del quale la Commissione ha delineato le fasi, i criteri e i limiti
