L’incontrollabile espansione dell’irripetibilità

The broad theme of the unrepeatability in the criminal trial is analysed in its different profiles. Moreover the study is focalized on the last 30 years of life of criminal procedure code, following the main reforms that have concerned the subject of unreapeatability. The paper examines the ways in which the unrepeatability has been expanding in the face of an ever greater permeability of the hearing to investigative acts.

Il complesso ed ampio tema dell’irripetibilità, nelle sue diverse sfaccettature che l’ordinamento processuale varato nel 1988 delineò, ha visto in questi 30 anni di vita del codice di rito susseguirsi molteplici e rilevanti mutazioni, in linea con le principali riforme che hanno riguardato il processo penale. Nello scritto si esaminano le modalità attraverso cui l’irripetibilità è andata espandendosi a fronte di una sempre maggiore permeabilità del dibattimento agli atti investigativi.
