This work deals with a topic of particular environmental and economic interest. This is linked to the management of the water resource for the needs of the community and the simultaneous protection of the water environment. An updated state‐of‐the‐art of scientific contributions and laws on this issue is provided. In particular, the analysis concerns the aspects related to the acquisition and processing of the data necessary for the correct management of water resources. For this purpose, it deepens the experience gained in the Tiber river basin by the competent Basin Authority. A particular analysis is dedicated to regulatory aspects starting from Law no. 183 of 1989 ʺRules for the organizational and functional reorganization of soil protectionʺ and the subsequent Law no. 36 of 5 January 1994, known as the Galli law. These laws sought to codify an objective technical approach to represent all the terms of the problem for the correct management of the renewal and issue procedures of the water concessions. The work therefore wants to bring a further contribution on the tools to evaluate in quantitative terms the fundamental variables for the management of this problem: natural flow rates, potential or measurable flow rates, usable flow rates and residual flow rates for technical‐lexical integration of what is encoded in the decree of the Ministry of the Environment and Territorial Protection of 28 July 2004. Finally, the work provides an articulated framework on the technicalregulatory approaches adopted for the definition of the DMV better defined as Ecological Flow for the conservation of the river habitat. In this regard, the methodology used by the Tiber River Basin Authority and the results achieved at the end of the experimental campaign conducted in the basin are discussed.
Il presente lavoro affronta un tema di particolare interesse ambientale ed economico legato alla gestione della risorsa idrica per i fabbisogni della collettività e alla contemporanea tutela dell’ambiente idrico. Viene fornito il quadro aggiornato dei contributi scientifici e delle disposizioni normative su questo tema. In particolare l’analisi riguarda gli aspetti legati alla acquisizione ed elaborazione dei dati necessari per la corretta gestione del patrimonio idrico e approfondisce per questo scopo l’esperienza maturata nel bacino del fiume Tevere dall’Autorità di Bacino competente. Un’analisi particolare è dedicata agli aspetti normativi che, a partire dalla Legge n. 183 del 1989 “Norme per il riassetto organizzativo e funzionale della difesa del suolo” e dalla successiva Legge n. 36 del 5 gennaio 1994, nota come legge Galli, hanno cercato di codificare un approccio tecnico oggettivo per rappresentare tutti i termini del problema per la corretta gestione delle procedure di rinnovo e rilascio delle concessioni idriche. Il lavoro vuole quindi portare un contributo ulteriore sugli strumenti per valutare in termini quantitativi le variabili fondamentali per la gestione di questo problema: le portate naturali, le portate potenziali o misurabili, le portate utilizzabili e le portate residue ad integrazione tecnico‐lessicale di quanto codificato nel decreto del Mistero dell’Ambiente e della Tutela del Territorio del 28 Luglio 2004. Il lavoro fornisce infine un quadro articolato sugli approcci tecnico‐normativi adottati per la definizione del DMV meglio definito come Deflusso Ecologico per la conservazione dell’habitat fluviale. A riguardo vengono discussi la metodologia impiegata dall’Autorità di Bacino del fiume Tevere e i risultati conseguiti al termine della campagna sperimentale condotta nel bacino.
