The essay is dedicated to the discipline which, in order to prevent the spread of SARS-CoV-2 infection, imposed the obligation to exhibit the green COVID-19 certification, as a requirement for access to the workplace. The contribution, after a brief reconstruction of the debate on the existence of the vaccination obligation in the working environment, analyzes the rules on the Green Pass that affect the private sector. The study, in particular, focuses on the field of application of the discipline, on the system of controls and on issues relating to the protection of privacy, on the legal and sanctioning consequences related to the no possession of the Green Pass, as well as on systematic implications and relations with the regulations on health and safety at work.
Il saggio è dedicato alla disciplina che, al fine di prevenire la diffusione dell’infezione da SARS-CoV-2, ha imposto l’obbligo di esibizione della certificazione verde COVID-19, quale requisito di accesso nei luoghi di lavoro. Il contributo, premessa una breve ricostruzione del dibattito sull’esistenza di un obbligo vaccinale in ambito lavorativo, analizza le regole in materia di Green Pass che interessano il settore privato. Lo studio, in particolare, si concentra sul campo di applicazione della disciplina, sul sistema dei controlli e sulle questioni relative alla tutela della privacy, sulle conseguenze giuridiche e sanzionatorie connesse al mancato possesso del Green Pass, nonché sulle implicazioni di carattere sistematico e sui rapporti con la disciplina in materia di salute e sicurezza sul lavoro.
