La positivizzazione normativa della ‘retorica della resilienza’. Riflessioni sulla crisi dei fondamenti pluralisti e sociali nel costituzionalismo italiano del tempo presente

Since the dawn of its process of affirmation, the language of constitutionalism – coagulated on a recognizable “catalog” of key terms – appeared to be accompanied by an intrinsic interconnection with the dimension of its rhetorical use. This essay develops the observation of how, in the face of a ‘new rhetoric of the crisis’ (crystallized around the financial crisis 2007-2008 and, increasingly, around the pandemic crisis), a corresponding ‘rhetoric of solutions [to the crisis]’ is visibly detectable, and how this rhetoric has been positivized within recent normative provisions. Particular attention will be placed on the lexicon at stake, especially with regard to the term «resilience» – now an omnipresent mantra – and on the peculiar de-constructive and re-constructive potentialities that characterize this pressing phenomenon. A phenomenon that deserves, on the part of the constitutionalist, specific attention due to various problems of systemic co-existence that arise with respect to the pluralist and social foundations of Italian constitutionalism.

Sin dagli albori del suo processo di affermazione, il linguaggio del costituzionalismo – coagulato intorno a un riconoscibile “catalogo” di termini chiave – si mostrava accompagnato da una intrinseca interconnessione con la dimensione del suo utilizzo retorico. Il saggio sviluppa l’osservazione di come, a fronte di una ‘nuova retorica della crisi’ (cristallizzatasi intorno alla crisi finanziaria 2007-2008 e, in maniera crescente, a quella pandemica), sia visibilmente rilevabile una corrispondente ‘retorica delle soluzioni [alla crisi]’, e di come questa retorica sia stata positivizzata all’interno di recenti fonti normative. Particolare attenzione verrà posta sul lessico in gioco, specialmente con riguardo al termine «resilienza» – ormai mantra onnipresente – e sulle peculiari potenzialità de-costruttive e ri-costruttive che caratterizzano questo incalzante fenomeno, meritevole di una specifica attenzione da parte del costituzionalista in ragione dei diversi problemi di co-esistenza sistemica che vengono a porsi in essere rispetto ai fondamenti pluralisti e sociali del costituzionalismo italiano.
