The analysis on the seminal contribution of Hans Kelsen to the development of the Verfassungsgerichtsbarkeit shows that the foundation of the centralized model of constitutional review of legislation relies on historical and institutional features of the Austrian model rather than on strictly theoretical reasons. The Kelsen’s legacy on centralized review, in that it aims at securing legal certainty and at shielding the constitutional court from value judgments, is critically examined once it is used as a theoretical framework for understanding the Italian system of constitutional review, even in light of the most recent judicial trends showing an expansive role for the Corte costituzionale.
