The article analyzes the legal regulation of career advancements of employees of companies under public control in the light of the art. 19 of the Legislative Decree n. 175/2016. Given the lack of explicit legal provisions, it is questionable whether the career advancements are subject to a selection procedure, as in the case of public servants, or depend on the decision of the employer on a discretionary basis, under civil law. The issue is addressed in the light of the recent case law – high and ordinary Courts - and of the legal theories and also considering the general rule pursuant to art. 19, paragraph 1, of the Legislative Decree no. 175/2016 and the other sanctioning measures (not only the nullity of the contractual act), both under civil law and taking into account the damages caused to the State. Finally, the essay examines the partially analogous issues arising from the conversion of the fixed-term contract to an open-ended contract in the companies under public control.
L’articolo analizza l’istituto delle progressioni di carriera del personale delle società a controllo pubblico alla luce della disciplina dettata dall’art. 19, d.lgs. n. 175/2016. In particolare, vista la mancata espressa regolazione della materia da parte del legislatore, ci si chiede se le progressioni siano soggette a una procedura selettiva, al pari del pubblico impiego, o siano rimesse ad un atto discrezionale del datore di lavoro, secondo il regime privatistico. La questione viene affrontata alla luce degli orientamenti recentemente espressi dalla dottrina e dalla giurisprudenza, di legittimità e di merito, e tenendo conto della regola di chiusura fissata dall’art. 19, comma 1, d.lgs. n. 175/2016 e degli altri strumenti sanzionatori, diversi dalla nullità, contemplati dall’ordinamento in ambito civilistico ed erariale. Il saggio si chiude con una riflessione sui problemi analoghi, ma non sovrapponibili, posti dalla conversione del contratto a tempo determinato nelle medesime società.
