Abstract

This paper investigates the normative context (sport, National and European) in which the reform of Article 33 of the Constitution, pending final approval by the Chamber of Deputies, is set. The amendment, in particular, enhances the value of sports activity in its three fundamental axiological dimensions: educational value, social value and the value of promoting psychophysical well-being. The constitutionalization of sports, therefore, lends itself to strengthening a legal paradigm different from the lex mercatoriathat increasingly conforms sports law, aimed at enhancing the fundamental rights of the individual.
