The aim of this article is to stimulate reflection on the model of organisation of confederal government functions in relation to the “Democratic Autonomy” school of thought. The article outlines the different epistemological presuppositions concerning the study’s subject in connection with the models of territorial and cultural autonomy previously classified by comparative legal scholars. Subsequently, the article analyses the development of institutional structures within the Zapatista and Kurdish movements. From an intercultural legal perspective, the case study will concentrate on the techniques suggested for empowering socially marginalized subjectivities. More specifically, we will examine how criticizing the political representation system has led to an alternative proposal that focuses on the active involvement of citizens in public duties. This new approach rejects the hierarchical and standardizing principles of the nation-state, and supports self- constitution processes and horizontal interconnectedness of human and ecological relationships
Il contributo intende avviare una riflessione sul modello confederale di organizzazione delle funzioni di governo legato al filone di pensiero dell’”Autonomia democratica”. Nell’elaborato vengono messe in luce, dapprima, le diverse premesse epistemologiche dell’oggetto di studio rispetto ai modelli di autonomia territoriale e culturale già classificati dai giuscomparatisti, successivamente, lo sviluppo delle forme istituzionali del movimento zapatista e curdo. Sotto il profilo del diritto interculturale, in particolare, l’osservazione dei casi si concentrerà sugli strumenti proposti per l’emancipazione delle soggettività sociali “subalterne”. Più specificamente, si vedrà come la critica al circuito della rappresentanza politica abbia generato una proposta alternativa basata sul coinvolgimento diretto dei cittadini nell’esercizio delle funzioni pubbliche che rovescia la logica gerarchica e omologante dello Stato-nazione, valorizzando i processi di “self-constitution” e l’orizzontalità delle relazioni umane ed ecosistemiche.
