In 2008 and 2009, the ICC issued an arrest warrant for crimes against humanity and war crimes against Sudanese Head of State, Omar Al-Bashir, who enjoyed personal immunity from foreign jurisdiction under general international law; ordered the staying of proceedings against Lubanga Dyilo, due to the non disclosure by the Prosecutor of exculpatory materials obtained on the condition of confidentiality; determined the rules on victims' participation to the proceedings; joined the cases concerning Katanga and Ngudjolo Chui; defined the role of the Prosecutor and of the Registry in the relocation of witnesses (in DRC); granted the defence motion for interim release of Bemba Gombo, pending the opening of the trial (in RCA); and found proprio motu the cases against Ugandian rebels admissible pursuant to Articles 17 and 19 of the Statute.
