Tribunale domestico nel Digesto?

The activity of a ‘domestic court’ within the Roman family is a matter of debate among scholars. After a brief summary of the different opinions expressed on the topic, a passage by Ulpian introduced in the Digest by the compilers of Justinian was considered. In it, some see a reference to the operation of the consilium domesticum, which, however, is neither stated nor implied in the jurist’s text.

L’attività di un ‘tribunale domestico’ all’interno della famiglia romana è oggetto di dibattito tra gli studiosi. Il lavoro, dopo un breve richiamo delle diverse opinioni espresse sull’argomento, prende in considerazione un brano di Ulpiano introdotto nel Digesto dai compilatori di Giustiniano. In esso, alcuni vedono un riferimento al funzionamento del consilium domesticum, che, tuttavia, non è né affermato né implicito nel testo del giurista.
