The reform, introduced by Legislative Decree No. 149/2022, aims to streamline and expedite the liquidation phase by outsourcing sale operations to qualified professionals such as notaries, lawyers, and accountants. It delves into the expansion of the delegates' responsibilities, the introduction of new methods for registration in the professional lists, and the strengthening of oversight over the delegates' activities. The contribution highlights the shift towards greater efficiency and the progressive alignment of judicial sales with standard private sales practices.
L'articolo analizza la riforma del processo civile italiano con particolare riferimento alla delega delle operazioni di vendita nelle procedure di espropriazione forzata. La riforma, introdotta dal d.lgs. n. 149/2022, mira a semplificare e velocizzare la fase di liquidazione, esternalizzando le operazioni di vendita a professionisti qualificati come notai, avvocati e commercialisti. Viene approfondito l’ampliamento delle competenze dei delegati, l’introduzione di nuove modalità di iscrizione agli elenchi e il rafforzamento dei controlli sull’operato dei delegati. Il contributo sottolinea il passaggio verso una maggiore efficienza e la progressiva assimilazione della vendita giudiziaria a quella di diritto comune.
