The article, in identifying the main regulatory rules that govern the do not significant harm principle, DNSH, raises the question of whether it is actually a principle or, instead, another regulatory rule. The answer is negative, in the sense that DNSH does not appear to be a principle, but rather a selection criterion between significant and non-significant harm. It is also highlighted that DNSH does not have an expansive force, being rather a conditionality for the disbursement of European funds, with particular regard to the PNRR.
L’articolo, nell’individuare le principali regole normative che disciplinano il principio do not significative harm, DNSH, si pone l’interrogativo se effettivamente sia un principio o, invece, altra regola normativa. La risposta è negativa, nel senso che DNSH non sembra essere un principio, quanto piuttosto un criterio di selezione tra danni significativi e non. Si evidenzia, altresì, che DNSH non ha una forza espansiva, essendo piuttosto una condizionalità per l’erogazione dei fondi europei, con particolare riguardo al PNRR.
