Il passo di Paolo, accolto in D. 45.1.132, ci mette a confronto con la possibilità di considerare forme di transito di figli da un nucleo familiare ad un altro realizzate senza il ricorso allo strumento giuridico dell’adozione. Il giurista, infatti, fa riferimento a una susceptio filiorum che esplicitamente distingue dall’adozione effettuata legitime. Gli studiosi hanno generalmente ritenuto queste susceptiones derivanti da pratiche provinciali, ma una considerazione complessiva delle testimonianze porta alla conclusione che esse siano state proprie dell’ambiente romano.
