This study explores the gap between descriptive and substantive minority representation in constitutional systems, employing comparative legal methods and case studies from the Global North and the Global South. The contribution endeavors to provide a classificatory framework for the most suitable indicators to assess the actual effectiveness of political representation tools for minorities. Despite the potential of both “legally guaranteed” and “politically ensured” forms of preferential representation, “mirror” representation has not always assured the substantive impact of minorities on political decisions. This contribution also questions the compatibility of such mechanisms with liberal representative democracy, seeking to provide qualitative insights into the impact of representation policies on minority political inclusion.
Il presente contributo indaga il divario tra la rappresentanza descrittiva e sostanziale delle minoranze nei sistemi costituzionali, attraverso un approccio di diritto comparato e l’osservazione di casi di studio provenienti tanto dal Global North quanto dal Global South. L’obiettivo è di fornire un quadro classificatorio degli indicatori più idonei a valutare l’effettività degli strumenti di rappresentanza politica per le minoranze. Nonostante il potenziale della rappresentanza politica preferenziale “legally guaranteed” e “politically ensured”, la “mirron representation” non ha sempre garantito un’influenza sostanziale delle minoranze sulle decisioni politiche. L’indagine mette inoltre in discussione la compatibilità di tali meccanismi con la democrazia rappresentativa liberale, cercando di approfondire l’impatto delle politiche di rappresentanza sull’inclusione politica delle minoranze.
