Sui c.d. errores in procedendo nel giudizio di cassazione

The essay criticizes the traditional theory of the dual function of the Corte di cassazione, arguing that the task of ensuring uniform interpretation of the law (nomophylaxis), as well as the issue of the limits of the Court’s review, should be framed within a single paradigm: this applies both to errores in iudi- cando (errors in judgment) and to errores in procedendo (procedural errors). Therefore, also in light of abundant case law, it proposes rethinking the balance between the general interest and the individual interest in a fair decision solely on the basis of the structure of the relevant proceedings, within which even an error of fact may be reviewed, if it is evident and results from the record.

Il saggio critica la tradizionale teoria della doppia funzione della Corte di cassazione, affermandosi che il compito della nomofilachia nonché il problema dei limiti alla cognizione della Corte vadano inquadrati in un unico paradigma: sia per gli errores in iudicando sia per gli errores in procedendo. Quindi, anche alla luce di abbondante giurisprudenza, si propone di rivedere l’equilibrio tra l’interesse generale e l’interesse particolare alla giusta decisione solo in virtù della struttura del relativo giudizio, nell’ambito del quale può essere sindacato anche un errore in fatto, se evidente e risultante dagli atti.
