This article analyzes the Italian Constitutional Court’s Judgment No. 181 of 2024, asking whether it may mark a new turning point in constitutional case law on dual preliminarity. The obiter contained in Judgment No. 269 of 2017 has been “tempered” and clarified by subsequent rulings, but these have left a number of open questions. After analyzing the facts and the judgment, we will focus on two more specific aspects that qualify Judgment No. 181 of 2024, namely the shaping of the concurrence between judicial remedies and the extension of the applicability of the “269 scheme” beyond the perimeter of the Charter of Fundamental Rights of the European Union in relation to the physiognomy of the centralized review of constitutionality.
Il contributo analizza la sentenza n. 181 del 2024 della Corte Costituzionale, chiedendosi se possa rappresentare una ulteriore svolta nella giurisprudenza costituzionale sulla doppia pregiudizialità. Il noto obiter contenuto nella sentenza n. 269 del 2017 è stato “temperato” e chiarito da sentenze successive, che però hanno lasciato una serie di questioni ancora aperte. Dopo aver esaminato gli elementi fattuali e le considerazioni in diritto della sentenza, ci si concentra su due aspetti specifici che qualificano la sentenza n. 181 del 2024, ossia la precisazione di cosa si intenda per concorso di rimedi giurisdizionali e l’estensione dell’ambito di applicabilità dello “schema 269” oltre il perimetro della Carta dei diritti fondamentali dell’Unione europea, da considerarsi in relazione alla fisionomia del controllo accentrato di costituzionalità.
