The relationship between the Constitutional Court and the Parliament has long been analysed due to the increasing creativity of case law when implementing constitutional principles in situations characterized by an objective regulatory vacuum. Recently, the Constitutional Court has used more flexible decision-making techniques than in the past, oscillating between direct intervention and respecting the legislature’s discretion. This approach aims to ensure the superior normativity of the Constitution while avoiding an excessive downsizing of Parliament’s role. Several unresolved issues relate to the Constitutional Court’s methods of intervention, as demonstrated by its recent use of the “rime adeguate” technique without double pronouncements. While this technique allows more flexible and “responsive” decisions in the absence of timely legislative intervention, the Constitutional Court must address the risks associated with the pervasiveness of its intervention. The Constitutional Court has faced significant criticism for its alleged interventionism and deviation from original constitutional review standards. Therefore, there remains a need to balance the effectiveness of constitutional review with the preservation of legislative discretion.
Il rapporto tra la Corte costituzionale e il legislatore è da tempo oggetto di studio, a causa della crescente creatività della giurisprudenza nel dare attuazione ai principi costituzionali in situazioni oggettive di vuoto normativo. Di recente, la Corte costituzionale ha fatto ricorso a tecniche decisorie più flessibili rispetto al passato, oscillando tra l’intervento in sede di giudizio di legittimità costituzionale e il rispetto degli spazi di discrezionalità del legislatore, con l’obiettivo di garantire la superiorità della Costituzione e di evitare un eccessivo ridimensionamento del ruolo del Parlamento. Una serie di problemi ancora irrisolti riguarda le modalità di intervento della Corte costituzionale, come dimostra il recente ricorso alle “rime adeguate” senza doppia pronuncia. Sebbene quest’ultima tecnica decisoria consenta di giungere a decisioni più flessibili e tempestive rispetto alla tutela dei diritti fondamentali in assenza di un intervento legislativo, la Corte deve confrontarsi con i rischi connessi alla pervasività del suo ruolo nelle dinamiche ordinamentali. Non sono infatti mancate le critiche verso il presunto interventismo della Corte, nonché verso il supposto scostamento dai canoni originari del giudizio di costituzionalità. È quindi necessario seguire gli sviluppi della giurisprudenza, nella prospettiva di un bilanciamento tra l’efficacia del controllo di costituzionalità e la tutela della sfera di discrezionalità del legislatore.
